2. Membership Plans

Qathiya offers tiered membership plans to provide a range of features and functionalities tailored to the needs of our users. Each plan offers increasing benefits as you upgrade.

Here's a breakdown of the membership plans:

  • Priority listing in relevant search results within the lawyer directory.
  • Ability to create groups.

3. User Accounts

Account Creation:

To register for an account, you must be a registered lawyer at your country's bar association and have the legal capacity to enter into a binding contract. The registration process includes verification to confirm your lawyer status.

You will be asked to provide certain information during registration, including your name, email address, username, phone number, date of birth, bar association name, bar association registration number and civil identification card or passport. You are responsible for ensuring that all information provided is accurate, complete, and up-to-date.

Account Management:

• You are responsible for all activity that occurs under your Account.
• You can access and update your account information at any time through your account settings.
• You can deactivate your account at any time by contacting the Company.

4. User Content

You may be permitted to submit content to the Platform, including:

• Messages in community forums and discussion boards.
• Posting pictures, videos and documents (subject to specific guidelines).
• Articles, infographics, or other educational resources (subject to Company approval).

Ownership and Licensing:

• You retain all ownership rights to your User Content.
• By submitting User Content to the Platform, you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and translate your User Content for the purpose of operating and improving the Platform.
• You represent and warrant that you have all necessary rights and permissions to submit your User Content and that your User Content does not violate the intellectual property rights or other rights of any third party.

Content Guidelines:

• User Content must be relevant to the Platform and its community.
• User Content must not be: 
  
  • Defamatory, obscene, hateful, or discriminatory.
  • Infringing on the intellectual property rights of others.
  • Spamming or other unsolicited communications.
  • False, misleading, or deceptive.
  • Illegal or unauthorized.
  • Violating the privacy of others.
• The Company reserves the right to remove or edit any User Content at its sole discretion.

5. User Conduct

You agree to use the Platform in a respectful and lawful manner. You agree not to:

• Impersonate another person or entity.
• Solicit or advertise without the Company's prior written consent.
• Interfere with or disrupt the operation of the Platform.

6. Member's Directory

Purpose

• The Directory is intended to connect clients with professional lawyers in Kuwait.
• The Company does not endorse or recommend any particular lawyer, and all information in the platform is provided by the lawyers themselves.

Listing Requirements

• Lawyers listed on Qathiya must be licensed to practice law in good standing in Kuwait.
• Lawyers are responsible for maintaining the accuracy and completeness of their profile information.
• Lawyers may be subject to additional verification by the Company.

User Disclaimer

• You are responsible for conducting your own due diligence before hiring any lawyer listed on the platform.

• • The Company does not make any representations or warranties about the qualifications or services of any lawyer listed on the platform.
  • You are encouraged to consult with multiple lawyers before making a decision.

7. Disclaimer of Warranties

The Platform is provided "as is" and without warranties of any kind, express or implied. The Company disclaims all warranties, including but not limited to:

• Warranties of merchantability.
• Fitness for a particular purpose.
• Non-infringement.
• Availability or uninterrupted use of the Platform.
• Accuracy or completeness of the information contained on the Platform.

8. Limitation of Liability

The Company will not be liable for any damages arising out of or related to your use of the Platform, including but not limited to:

• Direct, indirect, incidental, consequential, or punitive damages.
• Damages for loss of profits, data, goodwill, or other intangible losses.
• Personal injury or property damage arising out of your use of the Platform.

14. Additional Provisions

Disputes between Users

You are solely responsible for any interaction you have with other users on the Platform.

The Company will not mediate disputes between users.

Indemnification:

You agree to indemnify and hold harmless the Company, its officers, directors, employees, agents, and licensors from and against any and all claims, demands, losses, liabilities, costs, or expenses (including attorneys' fees) arising out of or related to your use of the Platform or your violation of these Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

Waiver:

No waiver by the Company of any breach of these Terms shall be deemed a waiver of any subsequent breach.

Assignment

The Company may assign its rights and obligations under these Terms to any third party at any time without notice to you.

Force Majeure

The Company shall not be liable for any delay or failure in performance due to causes beyond its reasonable control, such as acts of God, war, terrorism, strikes, or natural disasters.

Headings

The headings used in these Terms are for convenience only and have no legal or contractual effect.
